FAA Re-Registration Information

The Federal Aviation Administration issued regulations on 20 July 2010, which require re-registration of all aircraft registered prior to October 1, 2010, and also mandates the renewal of all registered aircraft every three years thereafter.

Aircraft Guaranty as Owner Trustee will conduct the re-registration of all aircraft for which it acts as Owner Trustee. There is no action on the part of the beneficiary other than to react to written instructions issued to it by the Trustee when the time comes to re-register.

And take special note - the Owner Trustee must perform the re-registration act.

You can determine the time of your initial re-registration by referring to the below table.

RE-REGISTRATION

This re-registration process will continue on a rolling basis over the next three years. The regulation also establishes a three month filing window for each re-registration (the "Re-Registration Filing Window").

NOTE:

Under the new regulations, an aircraft can only be operated lawfully with the actual Certificate of Aircraft Registration on board.

There will not be a pink copy of the new Aircraft Re-Registration and Renewal Applications, AC Forms 8050-1A and 8050-1B.

Failure to respond timely to the Owner Trusteeƕs written instructions when the time comes to re-register your aircraft may result in any one or more of the following:

  • Grounding of the aircraft
  • Jeopardizing perfection of legal interests
  • Jeopardizing insurance coverage
  • Subjecting the registered owner to civil penalties for invalid operation of an aircraft (which can create liens that have priority over previously perfected interests) - and for which the beneficiary is ultimately liable for payment
  • Administrative cancellation of the N-number.

The FAA will send the re-registration and renewal notices to the Owner Trustee's address which is on file at the FAA. They will not send it to the aircraft operator or beneficiary.

Therefore it is of the utmost importance that both the designated beneficiary of the trust and the designated aircraft operator have their most recent contact information on file with the Trustee - postal address, courier address, phone, fax, email.

SPECIAL NOTE: ONLY THE OWNER TRUSTEE CAN PERFORM THE RE-REGISTRATION ACT.

DO NOT BE LED INTO BELIEVING THAT OTHERS CAN DO THAT FOR YOU.

TRUSTEE WILL NOT ACCEPT RESPONSIBILITY FOR ANY FAILURE TO RE-REGISTER OR ANY ADVERSE ACTIONS RELATED TO A RE-REGISTRATION IF THE ACT IS PERFORMED BY ANY THIRD PARTY.
